Discrimination at work?

Mustafa is Tunisian. He carries out seasonal work near Cavaillon with a temporary resident’s card. He picks fruits from June to September for a farmer from the region. He is housed in prefabricated barracks with a dozen farm workers like him.

He is regularly subject to racist comments from his team leader, and he had no days off during the month. He has alerted his employer about this situation of harassment several times but he has not followed up on it.

In this situation, what can Mustafa do?

The law obliges the employer to protect his employees against violence committed by other employees, by users or by clients. This verbal violence and the racist insults are forbidden by the law, so long as they can gather proof in order to file a complaint: in the case of insults, witnesses are indispensable in order to avoid the charges being dropped.
